A serious question: just because a person is injured at work, did the injury arise out of their employment?
Two recent claims in Florida dealt with this issue. In one claim, a teacher had been sitting and his leg "went to sleep". When he stood up the leg was still numb and he fell. His claim was denied because conditions at work did not cause his injury. In the other claim, a massage therapist had an unexplained fall while in her workplace. The claim was initially denied but reversed on appeal since the accident happened at work.
With people continuing to work at home, we are likely to see claims for injuries that raise the question: is it really work related or did it arise because of an unsafe act or condition in the home? When there are no witnesses it may not be possible to determine the truth.
